Rent arrears are the most common reason for possession in England. Acting early, using the right Section 8 grounds and following the court process precisely gives you the best chance of recovering both possession and the debt.

Early Warning Signs of Arrears — What to Do First

Contact the tenant within 7 days of a missed payment, in writing. Many short-term cashflow issues resolve quickly when discussed. Offer a payment plan and document everything.

The Section 8 Grounds for Rent Arrears

Three grounds cover rent arrears. Ground 8 is mandatory; Grounds 10 and 11 are discretionary.

Notice Periods for Arrears Grounds

Four weeks for all three. Cite Grounds 8, 10 and 11 together so the claim survives even if arrears dip below two months by the hearing.

The Deposit — Can You Use It for Arrears?

Only at the end of the tenancy via the deposit scheme dispute process. You cannot offset mid-tenancy without the tenant's agreement.

Universal Credit Direct Payment

Where the tenant claims Universal Credit, you can apply for a Managed Payment to Landlord (MPTL) so the housing element is paid directly to you. This often stops arrears escalating.

Court Process for Rent Arrears

After the notice period, file Form N5 (and N119 particulars). The court lists the hearing within 6–10 weeks. If granted, you receive a possession order — and can claim the debt at the same time.

Money Judgment — Recovering the Debt

A County Court Judgment for the arrears can be enforced via attachment of earnings, third-party debt order, charging order on property or High Court enforcement.

Can I evict for one month's arrears?+

Ground 8 requires two months. For less, you would rely on discretionary Grounds 10 or 11.

Will Universal Credit pay the arrears?+

Sometimes — via a Third Party Deduction up to 20% of the tenant's standard allowance, alongside the ongoing rent element.
